This is patently false!

It's most likely a gross misunderstanding regarding our attendee
guidelines. A summary of the guidelines is on line at:

The restroom guidelines are about 1/2 way down the page. You will see
there's no such regulation in there. It's all common sense and
consideration of others. Don't go in groups, don't be obvious, things
like that.

IANAL, but shortly after we started DLV, counsel advised us that there
was no such law. This was confirmed when one of our people asked a Metro
(Las Vegas PD) officer about it. This is covered in our FAQ:

We all need to quit worrying about using pubic restrooms and use them
when necessary, but discreetly, and with common sense for the purpose
and in the way they were intended. We must always use the restroom we
select in the way it was intended to accommodate the anatomy of those
for whom it was designated. F>M's who don't want to use an accessory can
always sit because men sit sometimes. M>F's must sit at all times.

Other common sense behavior includes avoiding long waiting lines and
crowded restrooms unless you are passing really well, i.e. you not only
look like the person with the anatomy you are representing yourself to
be, you are dressed in the same way as others using the restroom are
dressed. Here are some other necessities, going directly to and securing
yourself in a stall, using the toilet facilities appropriately,
rearranging yourself and checking yourself for paper that is dangling
behind or stuck to a shoe, tucked up skirt, etc. before exiting the
stall, washing up quickly at the sink, and getting out. Don't engage
others in conversation and M>F's should never ever engage in makeovers,
even lipstick can be applied elsewhere if there are others who seem to
be aware of your presence! Even if we are clocked, it is unlikely that
anyone would be more than mildly amused and perhaps bewildered unless
some egregious behavior occurs or inconveniences them causing them to
complain.

The more attention we bring to this the more likely some zealot is to
try to pass some legislation regarding it. If that happens and a M>F is
assaulted in a mens' room they will likely face a major lawsuit.

We've been lucky in that many of the very recent proposed
non-discrimination legislation has been TG-inclusive, unlike
the last draft of ENDA passed by the House. :(

As the article states, this proposed legislation would assert
the right of TGs to use gender-appropriate public facilities.

However, reading the article, one might infer, erroneously,
that it is currently illegal for a genetic male to use a
public ladies room. Again, IANAL, but a fairly exhaustive
search of statutes by an attorney failed to find any such
statute, anywhere in the Nevada Revised Statutes, Clark
County Code, or Las Vegas Municipal Code.

Not directly related, but one such search did uncover a
Clark County park regulation that does indeed prevent genetic
males from "entering or loitering nearby" a ladies restroom
in a public park, but this is in no way, according to
counsel, applies in such places as casinos, restaurants,
clubs, etc. This appears to be the source of the very
persistent rumor that such use is, indeed illegal in LV.

Should this proposed legislation pass, yes, then we will then
have a right to use gender-appropriate facilities. As of this
time, however, management can, by policy or by whim, restrict
our use, and has done so several times in the past.

This is one reason why we need to be very careful to use
public facilities appropriately!
