Unpaid check at Off The Strip Thursday ...

Unfortunately we have an unpaid check, well into three figures, from Off The Strip last night.

The management is describing the group as being seated "at the table right by the stairs. They will be showing us the exact table later tonight.

Some of us had problems receiving our checks in a timely manner last night. In my case, after waiting for over an hour and seeing no servers around anymore, I finally got the attention of the bartender who took my money, ran downstairs to find and pay my check, and returned with my change. The time stamp on my receipt is 21:37. At that time, I am pretty sure that there were others who still had not received their checks.

Sorry if this is not what you want to hear and sorry if I come off as a total b*tch about this.

Slowness of the serving staff due to a systems issue (point of sale system malfunction) and intentionally walking out on a check are two totally different issues!

The latter is, technically, "Defrauding an Inkeeper" under NRS and is a fairly serious offense!

Walking out on a check reflects very poorly on Diva Las Vegas and on the TG community as a whole.

We expect those who did not pay to please come forward and settle up. This is, unfortunately, two apparent walk-outs during the 2017 event and we expect better from our attendees.

I think you may be looking for this. [And the size of the unpaid check
plays a key role in determining the level/category of the crime. At
this point i would think that there is still opportunity to to come
forward and pay the check without fear of prosecution. ]

Chapter 205 Crimes Against Property
NRS 205.445 Defrauding proprietor of hotel, inn, restaurant, motel or
similar establishment.

NRS 205.445 Defrauding proprietor of hotel, inn, restaurant, motel or
similar establishment.

1. It is unlawful for a person:

(a) To obtain food, foodstuffs, lodging, merchandise or other
accommodations at any hotel, inn, trailer park, motor court, boardinghouse,
rooming house, lodging house, furnished apartment house, furnished bungalow
court, furnished automobile camp, eating house, restaurant, grocery store,
market or dairy, without paying therefor, with the intent to defraud the
proprietor or manager thereof;

(b) To obtain credit at a hotel, inn, trailer park, motor court,
boardinghouse, rooming house, lodging house, furnished apartment house,
furnished bungalow court, furnished automobile camp, eating house,
restaurant, grocery store, market or dairy by the use of any false
pretense; or

(c) After obtaining credit, food, lodging, merchandise or other
accommodations at a hotel, inn, trailer park, motor court, boardinghouse,
rooming house, lodging house, furnished apartment house, furnished bungalow
court, furnished automobile camp, eating house, restaurant, grocery store,
market or dairy, to abscond or surreptitiously, or by force, menace or
threats, to remove any part of his or her baggage therefrom, without paying
for the food or accommodations.

2. A person who violates any of the provisions of subsection 1 shall be
punished:

(a) Where the total value of the credit, food, foodstuffs, lodging,
merchandise or other accommodations received from any one establishment is
$250 or more, for a category D felony as provided in NRS 193.130. In
addition to any other penalty, the court shall order the person to pay
restitution.

(b) Otherwise, for a misdemeanor.

3. Proof that lodging, food, foodstuffs, merchandise or other
accommodations were obtained by false pretense, or by false or fictitious
show or pretense of any baggage or other property, or that the person
refused or willfully neglected to pay for the food, foodstuffs, lodging,
merchandise or other accommodations, or that the person gave in payment for
the food, foodstuffs, lodging, merchandise or other accommodations
negotiable paper on which payment was refused, or that the person absconded
without paying or offering to pay for the food, foodstuffs, lodging,
merchandise or other accommodations, or that the person surreptitiously
removed or attempted to remove his or her baggage, is prima facie evidence
of the fraudulent intent mentioned in this section.

4. This section does not apply where there has been an agreement in writing
for delay in payment for a period to exceed 10 days

There's also the possibility that whoever's check it was left enough cash on the table to cover it, and that that cash was later stolen by some unknown person.

This is absolutely disheartening to hear of.

There was a lot of impatience in the room when it came to the issues
with the checks. I get that but at the same time, patience is a
virtue...something which seems to be lost in so many areas of society
these days. It was clearly conveyed that the restaurant was experiencing
significant systems issues and the staff was doing their absolute best
to work through everything.

I believe I was sitting at said table, late arrival, one of the last to
order and receive my meal. Paid my bill to a wonderfully helpful
bartender who provided outstanding customer service all evening. There
is no excuse for anyone to have skipped out on a bill no matter how
little (or in this case, how significant) it was.

I am also disappointed because as we all should know, finding
establishments that meet ALL of our desired criteria for a large group
(private or semi-private seating, open menu, multiple checks or separate
totals, no deposits, etc) is very difficult. We have this annually with
Bahama Breeze and it seems that we should have it going forward with Off
The Strip...if they'll have us back. I hope that the management realizes
that while there is zero excuse for the unpaid check, some
responsibility should be absorbed on their part for trying to manage
such a large group in the way that they did. If the computer fails,
spend a couple bucks by bringing in an extra staff member to be the
financial gatekeeper for such a large party. At least that is what I
would have done.

I should be writing about the wonderful time I had at DLV for a mere two
days at the end of the week. I sincerely hope that Off The Strip would
have us return. I loved everything about the evening. Our people, the
room, the food & drink, the service, and the location couldn't have been
more perfect (right next door to the
premium-room-rate-hotel-with-poor-lighting-when-it-comes-to-applying-makeup
:) ).

Yes, let's please concentrate on the good things that happened during the past week, which were many, and not dwell on issues such as this, which were few. Let's discuss the fun things that happened! :)
